These Terms of Service (“Terms”) govern your access to and use of MissedCue (the “Service”), operated by MissedCue (“we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
MissedCue compares a business against nearby competitors and generates competitor gap reports, recommendations, and optional ongoing monitoring. Reports are decision-support tools based on publicly available information and automated analysis; they are not guarantees of accuracy, completeness, or results.
2. Accounts
You must provide accurate information when creating an account and are responsible for keeping your credentials secure and for all activity under your account. You must be at least 18 years old and able to form a binding contract. Agency account owners are responsible for the teammates they invite and for activity by those team members.
3. Plans, billing, and renewals
- The $10 Report Pass is a one-time purchase that adds a single paid scan to your account.
- The $50/month Pro plan includes a monthly allowance of scans plus monitoring while the subscription is active.
- The $99/month Agency plan includes a higher monthly scan allowance, client workspaces, and team seats.
Subscriptions renew automatically each month until cancelled. Payments are processed by our payment provider, Stripe; we do not store your full card details. Monthly scan allowances reset at the start of each calendar month and do not roll over. You may cancel at any time from Billing; access continues through the end of the current paid period. Except where required by law, payments are non-refundable.
4. Acceptable use
You agree not to misuse the Service, including by: scanning businesses or websites you are not authorized to research; attempting to disrupt, overload, or reverse engineer the Service; reselling or redistributing reports in violation of these Terms; or using the Service to violate any applicable law or third-party rights.
5. No guarantee of results
MissedCue identifies likely conversion and positioning gaps, but outcomes depend on factors outside our control, including the business, market, implementation, pricing, reputation, and follow-up. We do not guarantee increased leads, revenue, rankings, or any specific result.
6. Intellectual property
The Service, including its software, design, and content we provide, is owned by MissedCue and protected by applicable laws. Reports generated for your account are yours to use for your own business or client work. You may not copy or use our branding except as needed to share a report we produced.
7. Third-party content and sites
Reports may reference third-party businesses, websites, and data. We do not control and are not responsible for third-party content, and inclusion in a report is not an endorsement.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to us or others. Provisions that by their nature should survive termination will survive.
9. Disclaimers and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, MissedCue will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance.
